This is an interlocutory application by way of motion on notice by the applicant praying the court, inter alia, that the applicant, as mother, be given custody of the child; an order that the applicant resident in USA be allowed to take the child to live with her; an order that the respondent, grandmother, of the child release the child with immediate effect and give same to the biological mother. The Court, in making its ruling on the matter, relied on relevant statutes and international conventions on the rights of the child to order that the Applicant (who is the mother of the child) should have custody and consequently be entitled to take the child from Cameroon to the USA. An order was also made for the grandmother to release the child with immediate effect to the applicant.
