The parties in this suit are married with a child. The plaintiff avers that the defendant had acted in a malicious manner while seeking divorce as it had not been communicated to him. He also complained about the continued disrespect of the defendant which the defendant had denied. The defendant claimed that the plaintiff was adulterous. However, it was argued as if the adultery was being condoned by the defendant. Propriety claims were also made.
The plaintiff”s claim was dismissed with the defendant being granted divorce and custody of the child with reasonable access by the plaintiff. The plaintiff is to make a financial contribution to the maintenance of the child.
